Terms & Conditions

At Sabine Albers Photography, we always do our best to meet your needs and bring your creative vision to life. To keep things clear and ensure we’re on the same page, these Terms & Conditions outline how we work together, what you can expect from us, and what happens if something unexpected comes up.

We keep it simple: no heavy legal jargon or confusing fine print — just straightforward terms that protect us both.

1. Key Definitions

“Agreement” – This includes these Terms & Conditions, the approved proposal or quote (including the agreed deliverables, fees, and timeline), and any additional written supplements agreed to by both of us.

“Photographer”, “we”, or “us” – Refers to Sabine Albers Photography.

“Client”, “you”, or “your” – Refers to you, the individual or business engaging our services.

“Project” or “Services” – Refers to the photography and/or videography services agreed upon in the scope of work.

“Deliverables” – The final, edited images and/or video files we provide to you.

“Expenses” – Additional costs related to the project, such as travel, accommodation, permits, props, equipment hire, or other out-of-pocket costs required to complete the work.

2. What We Both Agree To

We agree to:

  • Provide photography and/or videography services as outlined in your approved proposal.
  • Carry out the project in a professional and timely manner.
  • Keep you updated and communicate clearly throughout the process.

You agree to:

  • Provide clear and timely communication and any materials, access, or approvals needed to complete the work.
  • Provide feedback promptly during reviews to help us keep to the timeline.
  • Understand that delays in feedback or approvals may delay delivery and may incur additional fees if extra time or rescheduling is required.

 3. Payment, Cancellations & Postponements

Booking Deposit
A non-refundable deposit of 50% of the quoted fee is required to secure your booking. By paying this deposit, you accept these Terms & Conditions.

Final Payment
The balance is due on delivery of your final images or videos, unless otherwise agreed in your proposal or invoice.

Cancellations & Postponements
We understand that plans can change. If you cancel, your deposit is non-refundable and any costs already incurred (like travel or location fees) will be invoiced.

If you need to move your shoot, your deposit will carry over to the new date as long as we can reschedule within a reasonable timeframe and subject to availability. Any non-recoverable costs will be added to the final invoice.

If we ever have to postpone due to illness, weather, or something beyond our control, we’ll work with you to find a new date at no extra charge, or refund any payments made (excluding the deposit) if rescheduling isn’t possible.

4. Copyright & Usage

  • All photographs and videos created by Sabine Albers Photography remain the intellectual property of the Photographer.
  • You are granted a non-exclusive, non-transferable licence to use the final edited images and/or videos for the purposes outlined in the project agreement (e.g., personal, promotional, or commercial).
  • Any usage outside the agreed scope (e.g., resale, large-scale advertising, or third-party licensing) must be approved in writing and may incur additional licensing fees.
  • You may not edit, crop, add filters, or otherwise manipulate the images or videos without our written permission.

5.  Original Files

  • Final edited images and/or videos will be delivered as per the agreed deliverables.
  • Unedited RAW image files, unprocessed video footage, and editable project files (e.g., Premiere Pro timelines) are not included in the standard fee.
  • Should you wish to purchase original files, this must be requested in writing and will be quoted separately based on the scope of work.
  • We reserve the right to decline release of original files where it may compromise creative integrity or professional standards.

6. Editing & Retouching

  • All editing, including colour correction, exposure adjustments, and creative enhancements, will be carried out at our professional discretion.
  • Retouching or advanced image manipulation (e.g., object removal, heavy skin editing, composite edits) is not included unless specified in the proposal and may be quoted separately.
  • Requests for revisions beyond the agreed scope may result in additional fees.

7. Delivery

  • Final edited images and/or videos will be delivered digitally within the agreed timeframe once full payment has been received.
  • Delivery times may vary for complex projects, and timelines will always be communicated clearly.

8.  Liability

  • We will take every reasonable step to deliver high-quality images and video as agreed.
  • We are not liable for delays or outcomes affected by circumstances beyond our control, such as weather, venue restrictions, illness, or equipment failure.
  • In the unlikely event we cannot deliver as agreed, our liability is limited to the amount paid for the project.

9.  Indemnity

You agree to indemnify and hold harmless Sabine Albers Photography from any claims, damages, or expenses arising from your use of the images or videos, or any issues related to releases, permissions, or third-party usage that you are responsible for.

10.  Confidentiality

Both parties agree to maintain confidentiality of any proprietary, sensitive, or non-public information shared during the course of the project.

11. Portfolio Use

We love to share the stories we create. Unless otherwise agreed in writing, we reserve the right to use selected images and/or video excerpts in our portfolio, social media, and marketing materials. We will always respect any agreed confidentiality requirements.

12.  Client Materials

To keep things running smoothly, we rely on you to share any materials, access, or info we need for your project. This might include brand assets, product samples, schedules, or location details.

By working with us, you confirm that:

  • Anything you provide is accurate, complete, and ready to use.
  • You own it or have permission to use it — logos, graphics, products, or any other content.
  • You’ve arranged permission for us to shoot at the agreed locations and to feature any people, products, or properties.

 Location Access
If a location needs a permit, parking arrangements, or access fees, that’s your responsibility unless we’ve agreed otherwise. We’re happy to advise, but any costs will be added to your final invoice.

People & Permission
If people are featured in your photos or videos, you’re responsible for getting signed model releases. We can provide a template if you need one.

Extra Services
If you’d like us to handle extra tasks like writing copy, sourcing music, or coordinating third-party services, we’ll quote and invoice for that separately.

3. Governing Law

These Terms & Conditions are governed by the laws of Western Australia, and any disputes will be handled under its jurisdiction.

14.  Final Notes

We keep these terms simple and fair. By paying your deposit and engaging our services, you confirm you’ve read, understood, and agreed to these Terms & Conditions.
